The Master's Program in Valuation and Property Management (MMPP) at the Postgraduate School of Universitas Sumatera Utara (SPs USU) held a workshop on "Property Appraisal with Partial Ownership."

 

The Master's Program in Valuation and Property Management (MMPP) at the Postgraduate School of Universitas Sumatera Utara (SPs USU) held a workshop on "Property Appraisal with Partial Ownership" on Saturday, December 16, 2017. The workshop featured a keynote speaker, Mr. Ocky Rinaldy, S.E., M.Sc., MAPPI (Cert), and a public appraiser from KJPP Suwendho Rinaldy & Rekan Jakarta.

 

The event began with a welcome speech by the Head of the MMPP Study Program, Dr. Khaira Amalia Fachrudin, MBA, Ak., CA, MAPPI (Cert). She explained that the workshop aimed to help students understand the concept and practice of appraising properties with partial ownership, such as BOT (Build, Operate, Transfer) for landowners and developers. Additionally, the workshop aimed to provide a basis for recommendations to parties who own land assets, whether individuals or government and private institutions, in optimizing the benefits of cooperation in the form of royalties or profit sharing.

 

The next part of the event was a welcome speech and official opening by the Director of SPs USU, Prof. Dr. Robert Sibarani, M.S. He expressed his appreciation for the event and hoped that the students would participate fully and take advantage of the opportunity to learn from the keynote speaker, a nationally recognized practitioner with extensive experience in the field. He drew an analogy between elementary school children's study patterns or educational mindsets, where approximately 90% of knowledge is given by the teacher/school, and 10% is self-sought, and doctoral students, where the reverse is true. He suggested that the same analogy applies to master's students, and encouraged them to take advantage of the workshop as an opportunity to seek out knowledge actively. He also expressed his hope that the MMPP Study Program, the only one of its kind in Indonesia, would be able to contribute significantly to North Sumatra and Indonesia, and that the workshop would contribute to the accreditation of the study program and the university.

 

The main event was the delivery of the workshop material by the keynote speaker, Mr. Ocky Rinaldy. He explained the basics of property appraisal with the concept of partial ownership, the definition of partial ownership, and examples of property appraisal with the concept of partial ownership. He also provided insights into the legal aspects of property that are commonly used as evidence of ownership in land appraisals, such as:

 

1.  Hak Milik (HM) - Right of Ownership
2 .  Hak Guna Bangunan (HGB) - Right to Build
3.   Hak Pakai - Right of Use
4.  Hak Guna Usaha (HGU) - Right to Cultivate
5.   Hak Pengelolaan - Right to Manage
6.   Hak Milik Satuan Rumah Susun (HMSRS) di atas tanah HGB - Strata Title on HGB Land
7.   HGB di atas HM - HGB on HM Land
8.  HGB di atas Hak Pengelolaan - HGB on Hak Pengelolaan Land
9.   HGB di atas HGB - HGB on HGB Land
10. HMSRS di atas tanah HGB dimana HGB tersebut di atas Hak Pengelolaan - Strata Title on HGB Land (HGB on Hak Pengelolaan Land)

The state grants these rights to individuals, legal entities, or regional governments/state-owned enterprises, giving them the authority to use land in the sense of controlling, using, utilizing, and/or taking certain benefits from a particular plot of land. From the above explanation, the concepts of single ownership, partial ownership, and partnership emerge.

 

Property appraisal with single ownership uses the market, income, and cost approaches. In contrast, for partial ownership, the income approach assesses the rights of the lessor (landowner) and the lessee (building owner/developer), but the results are controlled by the market and cost approaches.

 

Some examples of partial ownership evidence that are recognized in land appraisals in Indonesia include:
1.  HGB on Hak Pengelolaan Land
2.  Strata Title on HGB Land (HGB on Hak Pengelolaan Land)
3.  HP issued by government agencies other than BPN (National Land Agency)
4.  Green Certificate or long-term lease certificate in Surabaya and surrounding areas
5.  Other evidence of partial ownership

 

The event was attended by the secretary of the MMPP Study Program, Dr. Elisabet Siahaan, SE, M.Ec, students, alumni who have become public appraisers in Medan, and MMPP lecturers who actively participated in the discussion sessions. Topics discussed included utilizing Samosir community land to welcome investment in the Lake Toba Geopark area, the legal status of multi-story buildings/apartments, and other questions related to the concepts and techniques of property appraisal with partial ownership.
